About projAI LLC

These Terms of Service govern your access to and use of projAI, a product of projAI LLC, a company registered in the United States of America, with offices in Alice Springs (Australia), Dubai (UAE), and Delaware (USA).

Use of the Platform

projAI provides AI-assisted project controls analysis and reporting support for professional teams. All outputs are advisory in nature and must be reviewed and validated by authorized project personnel before any reliance is placed on them.

Users remain solely responsible for all final decisions, including commercial approvals, program governance, safety controls, and contractual commitments.

AI, Data and Human Review

projAI uses artificial intelligence, retrieval-augmented generation, project controls logic, and related automation to assist with schedule, cost, risk, reporting, tender, governance, and construction-management workflows. AI-generated content may be incomplete, outdated, inaccurate, or unsuitable for a specific contract, jurisdiction, site condition, or safety requirement.

AI outputs are decision-support material only. They do not replace professional judgement, project controls review, engineering sign-off, legal advice, contract administration, safety assessment, superintendent direction, insurance advice, or authority approval. You must independently verify all AI outputs, calculations, assumptions, recommendations, and generated reports before using them for commercial, contractual, safety, legal, regulatory, procurement, scheduling, payment, claim, or public-facing purposes.

Customer Data

Customer data may include project schedules, scope documents, cost information, EVM data, risk registers, reports, project names, user details, company details, uploaded documents, prompts, chat history, and generated outputs. You represent that you have the right to upload, process, and use all customer data submitted to projAI and that doing so does not breach confidentiality, privacy, employment, security, procurement, tender, contract, or intellectual-property obligations.

You should not upload personal information, sensitive commercial information, classified material, regulated information, third-party confidential information, or safety-critical material unless your organization has authorized that use and appropriate safeguards are in place. You remain responsible for project-specific retention requirements, records management, audit obligations, and determining whether outputs may be shared outside your organization.

AI Training, RAG and Learning

projAI may use customer-provided project information to generate project-specific context, RAG memory, report narratives, recommendations, lessons learned, and future project controls assistance within the platform. Where enabled, projAI may retain derived project context, embeddings, summaries, risk patterns, schedule signals, and lessons learned to improve continuity of service for the same customer account, project, portfolio, or authorized workspace.

projAI will not intentionally publish customer data or disclose it to unrelated customers. Customer organizations are responsible for configuring access, removing unauthorized users, and ensuring that uploaded information may be processed by cloud services and AI systems used to provide the platform.

Liability, Indemnity and Public Liability

To the maximum extent permitted by applicable law, projAI LLC is not responsible for losses arising from unverified AI outputs, user-entered data, incorrect project assumptions, incomplete uploads, third-party systems, delays, interruptions, procurement decisions, site execution decisions, contract administration decisions, safety decisions, or reliance on generated reports without appropriate professional review.

You agree to indemnify and hold projAI LLC, its officers, employees, contractors, and service providers harmless from claims, liabilities, damages, penalties, costs, and expenses arising from your misuse of the platform, unlawful or unauthorized data upload, breach of these terms, breach of third-party rights, or reliance on AI outputs without proper review. This indemnity does not apply to the extent a claim is caused by projAI LLC's fraud, wilful misconduct, or liability that cannot legally be excluded.

projAI is software and does not provide site supervision, engineering certification, safety management, public liability insurance, professional indemnity insurance, or contractor insurance coverage for your projects. You and your organization remain responsible for maintaining appropriate public liability, professional indemnity, workers compensation, contract works, cyber, and other insurance required for your activities, contracts, and jurisdictions.

Public, Legal and Safety Use

Do not use projAI outputs as the sole basis for public statements, legal submissions, payment claims, delay claims, safety instructions, regulator communications, tender representations, or contractual notices. Any such use must be reviewed by suitably qualified personnel and approved under your organization's governance process.

Access and Accounts

Access to platform features is governed by account authorization, organizational policy, and applicable service configuration. Accounts are non-transferable. You are responsible for maintaining the security of your credentials.

Intellectual Property

All platform technology, AI models, user interface elements, and product documentation are the intellectual property of projAI LLC. You may not copy, reverse engineer, or redistribute any part of the platform without prior written consent.

Service Updates

projAI LLC may update product functionality, AI models, and operational workflows to maintain service quality, resilience, and security posture. We will communicate material changes to subscribed users.

Governing Law

These terms are governed by the laws of the State of Delaware, United States of America, without regard to conflict of law principles.

Some jurisdictions provide consumer, small-business, privacy, workplace, insurance, or public-safety rights that cannot be excluded. Nothing in these terms is intended to exclude, restrict, or modify rights that cannot lawfully be excluded.
